Mediation Act for Western Australia - Discussion Paper

The Western Australian Government is committed to supporting private mediation in Western Australia while preserving its benefits as a creative and flexible process.

This Discussion Paper seeks stakeholder feedback on questions relating to the content, purpose and desirability of legislation to govern the practice of private mediation in Western Australia. It is envisaged that a Mediation Act would include provisions relating to such matters as confidentiality, the admissibility or otherwise of mediation communications as evidence, and immunity for practitioners.

The Department of Justice is asking for submissions in response to the specific questions in this Discussion Paper.

If you wish to respond to questions on matters contained in this paper, you can make a written submission. If you are unable to make a written submission but would like to provide your input, please contact the Department of Justice on the email address provided to enquire about alternative means.

You are not required to respond to every question asked however please indicate clearly the questions to which your responses relate.

To be considered by the Department of Justice, submissions must be received by close of business 16 December 2019.

Submissions should be titled Mediation legislation – Discussion Paper and preferably emailed to: LegPolicy@justice.wa.gov.au.
